Terms and Conditions (T&C)

These Terms and Conditions (T&C) apply to all business relationships between you and Hosting High Speed Bobardt Enterprises Inc. (hereinafter referred to as “we” or “us”). These T&C apply to customers in both the United States and the European Union (EU) and are applicable to the websites https://bobardt-enterprises.com/ and https://hostinghighspeed.com/.

1. Scope

These T&C apply to all contracts concluded via our websites and online stores. For customers in the EU, the provisions of the EU Consumer Rights Directive also apply.

2. Conclusion of Contract

The purchase contract is concluded when you complete the order and we confirm it. For EU customers, the contract is deemed concluded when you receive the goods and do not revoke within 14 days.

3. Right of Withdrawal (EU Customers)

Withdrawal Policy: EU customers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email).

Consequences of Withdrawal: If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs arising from choosing a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

4. Return Policy (USA Customers)

USA customers can return the goods within 30 days of receipt, provided the goods are undamaged, unused, and in their original packaging. We bear the return shipping costs.

5. Exclusion of the Right of Withdrawal

The right of withdrawal does not exist for contracts for the delivery of goods that are not prefabricated and for their production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

6. Delivery and Shipping Costs

Delivery is carried out by DHL or a comparable provider. Shipping costs are displayed during the order process.

7. Payment

We accept the following payment methods: invoice, credit card (MasterCard, Visa), PayPal, Sofortüberweisung, prepayment, and direct debit. Details on each payment method can be found in section 9 of our original T&C.

8. Warranty and Liability

EU Customers: Statutory warranty rights apply. USA Customers: Warranty rights are governed by the laws of the respective state.

9. Prices and Taxes

Prices are quoted in US dollars. For EU customers, prices include statutory VAT. For USA customers, additional local taxes may apply.

10. Retention of Title

The goods remain our property until full payment has been made.

11. Electronic Communication

You agree that contract-related communication can be carried out electronically.

12. Alternative Dispute Resolution

We are not obligated and not willing to participate in dispute resolution procedures before a consumer arbitration board.

13. Disclaimer for External Links

We assume no liability for the content of external links. The operators of the linked sites are solely responsible for their content.

14. Image Rights

All image rights are held by Hosting High Speed Bobardt Enterprises Inc. or our partners. Use without express consent is not permitted.

15. Storage of the Contract Text

The contract is concluded in German. We do not store the contract text and it cannot be accessed after the order process. However, you can print out the order data immediately after submitting the order.
