1. Introduction

Bobardt Enterprises Inc. (“Company,” “we,” “us,” or “our”) values customer satisfaction and strives to provide reliable and high-quality hosting and IT services. This Refund & Cancellation Policy outlines the conditions under which refunds and cancellations are permitted. By using our services, you agree to the terms set forth in this policy.

This policy complies with applicable U.S. consumer protection laws, including the Federal Trade Commission (FTC) guidelines, the California Consumer Protection Act (CCPA/CPRA), the Uniform Commercial Code (UCC) §2-725, and international directives where applicable.

2. General Refund Policy

Refunds are issued in accordance with the following conditions:

  • Subscription-Based Services (Hosting, Cloud, VPS, Dedicated Servers): Refunds are only available within the first 30 days of service (“Money-Back Guarantee”), unless otherwise stated in the service agreement.

  • One-Time Services (Consulting, Software Development, IT Support): Refunds are not available once service delivery has commenced.

  • Domain Registrations: Due to ICANN regulations, domain name purchases are non-refundable.

  • Software & Licensing Fees: Payments for software licenses, SSL certificates, and other third-party tools are non-refundable.

  • Unused Prepaid Credit: If a customer has prepaid for services, a refund may be issued for the unused portion, subject to a processing fee of 10%.

  • Chargebacks & Disputes: If a chargeback or dispute is filed with a payment processor, we reserve the right to suspend the account until the dispute is resolved.

  • Partial Refunds: In cases of service interruptions due to technical failures on our end, partial refunds may be considered on a case-by-case basis.

3. Cancellations & Termination

A. Customer-Initiated Cancellations

  • Customers may cancel their subscription or services at any time by submitting a cancellation request via their account dashboard or by contacting support@bobardt-enterprises.com.

  • Subscription-based services must be canceled at least 5 days before the next billing cycle to avoid automatic renewal.

  • If a cancellation request is submitted after the renewal date, the customer is responsible for the payment of that billing cycle.

  • If a service is canceled before the end of a contract term, no refunds will be issued unless explicitly stated in the agreement.

  • Automatic Renewals: All subscriptions automatically renew unless canceled at least 5 days before the billing date.

  • Price Adjustments: If pricing changes, customers will be notified at least 30 days in advance.

B. Company-Initiated Cancellations

We reserve the right to cancel or suspend services under the following circumstances:

  • Non-Payment: If payment is not received within 7 days of the due date, services may be suspended or terminated.

  • Violation of Terms of Service (ToS): Accounts found violating our Acceptable Use Policy (AUP) or engaged in prohibited activities (e.g., spam, hacking, illegal content) may be terminated without refund.

  • Fraudulent Transactions: If a transaction is suspected of fraud or unauthorized use, we may cancel the service immediately.

4. Refund Processing Time & Method

  • Refunds (if applicable) will be processed within 7-14 business days after approval.

  • Refunds will be issued to the original payment method (credit card, PayPal, wire transfer, etc.).

  • If a refund to the original payment method is not possible, the amount may be credited to the customer’s account for future use.

  • All refunds will be processed in USD. Exchange rate differences and bank fees are the responsibility of the customer.

5. Exceptions & Non-Refundable Services

Certain services are non-refundable, including but not limited to:

  • Domain registrations, renewals, and transfers

  • SSL certificates and licensing fees

  • Software development and consulting fees

  • Setup and administrative fees

  • One-time services or custom IT solutions

6. Chargeback & Dispute Resolution Policy

To prevent fraudulent chargebacks and disputes, customers are encouraged to contact us at support@bobardt-enterprises.com before filing a dispute with their bank or payment provider.

  • If a chargeback is filed, we reserve the right to suspend or terminate the associated account.

  • If a dispute is found to be invalid or fraudulent, the customer may be liable for additional administrative fees.

  • Disputes may be escalated to arbitration per U.S. Federal Arbitration Act (FAA) guidelines.

7. Refund & Cancellation Policy for EU Customers

For customers residing in the European Union (EU), additional protections apply under the Consumer Rights Directive (2011/83/EU) and GDPR regulations.

  • 14-Day Cooling-Off Period: EU customers have the right to cancel services within 14 days of purchase for a full refund, except for custom software, domain registrations, or completed services.

  • Immediate Service Activation Waiver: If a customer requests immediate activation of services (e.g., hosting, software installation), they waive their right to the 14-day refund period.

8. Service Interruptions & Cybersecurity Events

  • Refunds due to unexpected service outages, cyberattacks, or data loss will be assessed on a case-by-case basis.

  • Bobardt Enterprises Inc. is not liable for data loss due to customer negligence, third-party actions, or external cyber threats beyond our control.
